Information We Collect and How We Collect It

Information You Provide to One Beat Medical

Personal information we collect from you may include:

• Contact Information: such as your name, email address, postal address, and phone number.
• Account and Login Information: such as your username, password, security questions, and basic details about your account. Some forms on the Websites may require you to provide certain information in order to submit the form. You may elect to not provide this information, but doing so may prevent you from using or accessing features on the Websites.
• Payment Information: In order to access some of our services or purchase our products, you may also be required to provide us with payment information, including credit card number, billing address, shipping address, and other information necessary to complete a purchase. We use a third-party payment processor to collect this information.
• Mailing List Information: such as marketing and communications preferences and interests.
• Purchase Information: such as information regarding your purchase history with us.
• Sensory Information: Audio, electronic, visual or similar information, including photographs and CCTV footage.

We collect the aforementioned personal information from you so that we can serve you better, and so that we can provide you with our products and services, in addition to the other purposes described in the “How We Use Your Information” section below. For example, we may ask you to provide certain personal information when you wish to purchase a product, when you request a repair service, or when you subscribe to one of our newsletters. Should you choose to enroll in any of our voluntary rewards program, we will use your basic contact information to track your purchases and accumulate points to your account. Information Automatically Collected

One Beat Medical may also automatically collect certain information about you when you access or use the Websites (“Usage Information”). We may obtain information about you from our affiliates, service providers, business partners, and/or other third parties. For example, we may obtain data from remarketing sites such as Gobot. One Beat Medical may disclose information about you (including, without limitation, personal information we collect) for purposes that are consistent with this Notice or our statements at the point of collection and not prohibited by applicable law. For example, like many businesses, we use cookies, pixels, and similar technology on our website as further described in our section “Cookies” below, and we may disclose your personal information to third parties that we use to provide some of the services on or through the Websites, such as third parties that help us analyze site visitor and associated Usage Information, provide relevant advertisements to you, facilitate customer service, conduct promotional email campaigns, conduct customer surveys for internal use, and optimize the Websites. Your Rights

Depending on your location and applicable law, you may, under certain circumstances, have some or all of the rights listed below relating to your personal information. Additional information may be found in the specific jurisdictions sections below.

• Access your personal information and confirm how your personal information is being processed.
• Request the transfer of your personal information to another party or obtain a copy in a structured, machine-readable, or portable format.

Your request must provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information, or an authorized representative of such person, and describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the requested personal information relates to you. We will use the information provided in a request solely to verify your identity or authority to make the request.

California Shine the Light Law

California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our customers who are California residents to request a list of what personal information (if any) we disclosed to third parties for their direct marketing purposes in the last calendar year and the names and addresses of any such third parties. We currently do not, and have not in the preceding calendar year, disclosed any personal information with third parties for their independent direct marketing purposes.

Email Communications

Should you choose not to receive promotional emails from One Beat Medical or any of its affiliate entities listed above, you may opt out of receiving additional promotional email communications by following the unsubscribe link at the bottom of our emails. You may also contact us directly at privacy@onebeatmedical.com. Please note that even if you opt out of receiving promotional communications from us, we may continue to send you non-promotional emails, such as those related to your orders or product inquiries.

Security

One Beat Medical takes measures that are designed to protect your information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. You should be aware, however, that “perfect security” does not exist on the Internet, and there is always the risk that unauthorized persons may access or use your personal information. We will not be responsible or liable for any damages, losses, or causes of action arising out of or in connection with the disclosure of your personal information. You use our Websites and send us such information at your own risk. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Children’s Privacy Rights

The Websites are not intended for, nor targeted to, children under 13. We do not knowingly or intentionally collect information from children under 13. If we learn that we have received information directly from a child who is under the age of 13, we will delete the information in accordance with applicable law.

Information for California Residents

This subsection concerning the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and all regulations thereto (“CCPA”) applies to individuals who are residents of the State of California. CCPA provides consumers who reside in California with certain rights with respect to their personal information. This subsection is only relevant to you if you are a resident of California as determined in accordance with the CCPA and to personal information that is subject to CCPA. Information required to be disclosed to California residents under the CCPA regarding the collection and processing of their personal information that is not set forth in this CCPA supplement is otherwise set forth in the Notice.

• Personal Information Collection: The types of personal information we collect about you depends on the nature of your interaction with us. We collect (and in the past 12 months may have collected) the following categories of personal information: identifiers, commercial information, internet and electronic network activity, inferences, sensory information (i.e. audio, electronic, visual, thermal, and similar information) and other categories of personal information that relate to or are reasonably capable of being associated with you. • Personal Information Use: We may use (and in the past 12 months may have used) your personal information for the purposes described in “How We Use Your Information” above and for the following business purposes specified in the CCPA (i.e. auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards; helping to ensure the security and integrity of your personal information as is reasonably necessary and proportionate for these purposes; debugging to identify and repair errors that impair existing intended functionality; short-term, transient use including, but not limited to, non-personalized advertising shown as part of your current interaction with us; performing services, including maintaining or servicing accounts, providing customer service, processing, or fulfilling orders and transactions, verifying customer information, processing payments, providing analytical services, or providing similar services; providing advertising and marketing services to you; undertaking internal research for technological development and demonstration; and undertaking activities to verify or maintain the quality or safety of our services and to improve, upgrade, or enhance our services).

• “Sharing” and “Selling” Personal Information: As outlined in “How We Disclose Your Information” above, One Beat Medical uses certain Tracking Technologies such as Google Analytics. The retention of analytics data of the Websites by any third party analytics service provider may be deemed a “sale” of personal information under CCPA. You have the right to opt out of this type of disclosure of your personal information to third parties and we have provided opportunities on the Websites for you to exercise this right including a link that says “Do Not Sell or Share My Personal Information” on our homepage (available here) and a further link in the “Questions or Concerns” section of this Notice. Upon request, we are able to provide details of the categories of personal information we have “sold” to or “shared” (as these terms are defined in CCPA) with third parties, as further explained in the “Your Privacy Rights” section below. In the past 12 months, these categories of personal information typically only included Internet or other similar network activity data and geolocation data obtained through the Websites. We also do not have actual knowledge that we “sell” or “share” (as these terms are defined in CCPA) personal information of consumers under age 16.
• Sensitive Personal Information: We do not use or disclose sensitive personal information for purposes other than those specified in Section 7027(m) of the CCPA Regulations.

• Your Privacy Rights as a California Resident: Subject to certain limitations (including but not limited to our compliance with U.S. state, local and non-U.S. laws, rules, and regulations), California consumers have the right to (1) opt-out of the “sale” or “sharing” of your personal information, (2) request to know more about the categories and pieces of personal information we collect, use, and disclose, as well as the sources from which the personal information is collected and the purposes for collecting such personal information, (3) request deletion of your personal information, (4) request correction of any inaccurate personal information, and (5) not to be discriminated against for exercising these rights, including an individual’s right not to be retaliated against for the exercise of their CCPA rights.

California consumers or their authorized agents may make such a request by contacting us through any of the means described in the “Questions or Concerns” section. We will notify you in writing if we cannot comply with a specific request and provide an explanation of the reasons.

We will contact you to confirm receipt of your request under the CCPA and request any additional information necessary to verify your request. We verify requests by matching information provided in connection with your request to information contained in our records. Depending on the sensitivity of the request and the varying levels of risk in responding to such requests (e.g., the risk of responding to fraudulent or malicious requests), we may request further information such as login access credentials, if applicable, to verify your request. You may designate an authorized agent to make a request under the CCPA on your behalf if you provide a signed agreement verifying such authorized agent’s authority to make requests on your behalf, and we may verify such authorized person’s identity using the procedures above.

One Beat Medical reserves the right to change this Notice at any time. The revised Notice will be effective at the time of posting to the Websites.
